The transport of the consignment is an important part of the fulfilment of the trade agreement between the seller and the buyer which means that the trade agreements including the delivery terms shall be taken into account.
The delivery terms determine the responsibilities and risks of each company in the delivery chain. In Finland Finnterms 2001 and in international trade Incoterms 2000 delivery terms are applicable (the delivery terms are available on e.g. insurance company websites). The party applying for compensation shall be the one who according to the trade agreement bore the risk at the time the damage occurred.
The compensation claim is made as a compensation claim, not an invoice, unless specifically agreed upon. The compensation is not purchasing or selling referred to in the Value Added Tax Act, i.e. any compensation is remitted excluding VAT.
